PAYMENT TERMS
Advertised prices are in USD and exclude shipping, handling and taxes unless otherwise stated in the Checkout page. You are responsible to pay for all taxes associated with your order. MadCowShop has the sole discretion to revise the advertised prices periodically. MadCowShop will only process and ship all orders upon receipt of full payment unless MadCowShop has agreed in writing to other payment terms with you.

LOW ORDER FEE
All orders below US$10 are subject to a Low Order Fee. MadcowShop reserves the rights to adjust this fee from time to time. This fee is displayed at the Checkout page, if applicable.

DISCLAIMER OF WARRANTIES, LIMITATION OF LIABILITY
MadcowShop disclaims all other warranties, either express or implied, including implied warranties of merchantability or fitness for a particular purpose, other than those warranties implied by and incapable of exclusion, restriction or modification under applicable law. The term of any implied warranties cannot be disclaimed are limited to the term of this Condition of Use. MadCowShop and your maximum liability to the other are limited to the purchase price you paid for the products. Neither you or MadCowShop is liable to the other if you or MadCowShop are unable to perform due to events you or MadCowShop are not able to control such as acts of God or for property damage, personal injury, loss of use, interruption of business, lost profits, punitive or special damages. It is your responsibility to ascertain and obey all applicable local, state or country law in regard to possession and use of MadCowShop products.

INTELLECTUAL PROPERTY, TRADEMARK & PROPRIETARY INFORMATION
All MadCowShop products are intellectual properties of the company. The use of a MadCowShop product is governed by local and international Copyright and Patent legislation. No part of a MadCowShop product may be reproduced wholly or in part in any physical or electronic form without the written permission of MadCowShop. You shall not at any time use or disclose MI’s proprietary information without MI’s prior written authorization except in the course of, in connection with and during the performance of your duties under this Agreement.

GOVERNING LAW
Any dispute arising under or in any way connected with these terms and conditions shall be subject to the non-exclusive jurisdiction of the courts of, and governed by the law of, the country of origin of MadCowShop.

SEVERABILITY
The invalidity or unenforceability of any provision shall not affect any other part of these terms and conditions.

GENERAL
You may not assign this Condition of Use. If there is any inconsistency between this Condition of Use and any other agreement included with or relating to products purchased from MadCowShop, this Condition of Use shall govern. This Condition of Use may not be modified, altered or amended without the written agreement of MadCowShop. If any term of this Condition of Use is illegal or unenforceable, the legality and enforceability of the remaining provisions shall not be affected or impaired.
